The following terms and conditions constitute an agreement between you and QueueMed Healthtech Sdn Bhd ("QueueMed"), the operator of www.queuemed.com and related software provided by us and in respect of which these Terms and Conditions of Use are referenced (collectively "QueueMed Solutions"). These Terms and Conditions of use shall be read in conjunction our Privacy Policy. By accessing and using this website and Web App operated by us or accessing and using our online services, which are made available on our portal at www.queuemed.com or www.qmed.asia (Web App) through any medium, including but not limited to accessing the Web App through mobile phones, smart phones and tablets, you will be conclusively presumed to have notice of, and you acknowledge that you agree to comply with and be bound by these Conditions, as amended from time to time. These Conditions govern our relationship with you in relation to our Web App and supersede all previous oral and written terms and conditions (if any) communicated to you. By accessing and using our Web App, you signify your agreement to these Conditions as well as our privacy policy, a copy of which is available at www.queuemed.com/privacy-policy (which is hereby incorporated by reference herein). If you disagree with any part of these Conditions, you must immediately discontinue your access or use our Web App. The term “QueueMed”, “we” or “us” refers to QueueMed Healthtech Sdn Bhd and its affiliates (where applicable), and the term ‘our’ has a correlative meaning. The term “you” refers to the viewer or user of our Website, and the term “your” has a correlative meaning. We reserve the right to modify or terminate any portion of the Website, Web App or the Services offered by QueueMed for any reason, without notice and without liability to you or any third party. To make sure you are aware of any changes, please review these Terms of Use from time to time. QueueMed Solutions should not be used in cases of medical emergencies and QueueMed does not and should not be considered in any form to be a substitute for a doctor or a hospital.

QueueMed Solutions come in two packages:

• Online Appointment System
  QueueMed Solutions enable you to make appointments with doctors, dentists and/or other medical professional providers (collectively, "Doctor") that have engaged QueueMed to list their Solutions on the Web App. By accessing the Web App, you are able to view the Doctor's roster and their availability and provides the Doctor a platform to communicate and facilitate clinic appointment making with you. QueueMed has no control over and cannot guarantee the availability of the Doctor at all time, whereby such responsibility is upon the Doctor themselves. The Doctor reserve the rights to accept or decline any appointments made through the Web App.
  
  QueueMed shall not be held liable for cancelled or unfulfilled appointments, or any injury resulting therefrom, or for any injury resulting or arising from or related to the use of the Web App.



• Mobile Queue System
  QueueMed Solutions include an automated live queue system that uses priority-based sorting algorithms to determine the order of your queue in the healthcare service providers’ facilities. If you have a pre-arranged appointment, you will be given priority in the queue, followed by walk-in clients. Special care clients (To be defined by respective clinic, for example medical emergency and wheel-chair bound patients) will be given top priority for medical attention). The timing displayed serves only as an estimate and is not a guarantee that you will be served at the displayed time. The healthcare service providers reserve the right to alter the queue at their own discretion. QueueMed shall not be held liable for any delays or changes in timing of service, or any injury resulting therefrom, or for any injury resulting or arising from or related to the utilisation of the Software’s queue system.

Unless you have a different agreement signed with QueueMed, by accessing and using QueueMed Solutions, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable laws in Malaysia. If you do not agree with any of these terms, you are prohibited from using or accessing QueueMed Solutions. The materials contained in QueueMed Solutions are protected by applicable copyright and trade mark laws.

The information and materials located or hosted on, or linked to, our (the “Materials”) are protected by copyright, trademark and other forms of proprietary rights. Such Materials include, but are not limited to, any price information, data, photographs, graphics, illustrations, designs, trademarks, trade names, service marks, product names, logos, insignias or other devices, software programmes, downloadable files, software applications, interactive features, tools, services or other information or content made available on or through our Website. The presentation and layout of the Materials is also protected by copyrights, trademarks, service marks, international treaties and other proprietary rights and laws of Malaysia and other countries.

Unless otherwise stated, the rights, titles and interests to the Materials are owned by, licensed to or controlled by us.

All other trademarks, trade names, service marks, product names and logos contained herein that are not owned by, licensed to or controlled by us are used in an editorial fashion only, and to the benefit of respective owners, with no intention of trademark infringement.

You understand that third party services may be made available by the Company. For example, you may be able to book appointment through another website or mobile application via QueueMed Solutions. Please note that in the event you choose to receive any such third-party services that are made available, QueueMed will be required to provide your basic information to the third party services company necessary to fulfil your request. You will be absolutely and solely responsible for your interactions with such third-party service providers. QueueMed shall not be held responsible for any lapses, shortcomings or deficiency of services by such third party service providers to you. QueueMed provides these third party services to you solely for your convenience and hereby does not endorse the services of any third party service providers that are made available on the Website.

The materials appearing on QueueMed Solutions could include technical, typographical, or photographic errors. QueueMed does not warrant that any of the materials on QueueMed Solutions are accurate, complete, or current. QueueMed may make changes to the materials contained on QueueMed Solutions at any time without notice. QueueMed does not, however, make any commitment to update the materials.

You may access and view our Website and may save an electronic copy or print out a copy of the Materials, solely for your own personal and non-commercial use. All copies that you make must be in the form as presented on our Website and must include all applicable copyright and other notices on our Website.

Except with our prior written permission, you may not copy, store (either in hardcopy or in an electronic retrieval system), adapt, alter, translate, transmit, disseminate, distribute, perform, broadcast, publish, reproduce, publicly display, hyperlink, sell, license, rent, lease or otherwise transfer any of the Materials, or otherwise transfer any of the Materials to any other person (whether for direct commercial purpose or monetary gain or otherwise) or otherwise use in whole or in part in any manner.

Except with our prior written permission, you may not create a derivative work from the Materials, nor decompile, reverse-engineer or disassemble the Materials.

Any rights relating to the Materials and our Website not expressly granted herein are reserved and no licence or right is granted to you by implication, estoppel or otherwise.

No unlawful or prohibited use of our Website

You acknowledge and agree that, as a condition of your access and use of our Website, you will not use the Materials or our Website for any purpose that is unlawful or prohibited by these Terms of Use. You may not use our Website in any manner that could damage, disable, overburden or impair any QueueMed server, or the networks connected to any QueueMed server, or interfere with any other party’s access and use of our Website. You may not attempt to gain unauthorised access to our Website, or any services provided via our Website, other accounts, computer systems or networks connected to any QueueMed server or to any of the services provided via our Website, through hacking, password mining or any other means. You may not obtain, or attempt to obtain, any Materials or other information through any means not intentionally made available on or through our Website.

If you wish to schedule an appointment with a doctor on the Web App, you will have to register on the Website and become a registered user ("QueueMed User") prior to the completion appointment booking. To register onto the Website, a user will have to provide information such as his/her name, email address, phone number, Identity Card number and nationality.

Registration is only a one-time process and if the QueueMed User has been previously registered, s/he shall login / sign into his/her account using the same credentials as provided during the registration process. We request you to safeguard your password to your account on the Website and make sure that others do not have access to it. It is your responsibility to keep your account information current.

Protecting patient privacy and keeping your information secure are among our biggest priorities. Our Privacy Policy details how we may use, share, and maintain the information that you voluntarily share with QueueMed, which may include, without limitation, your name, phone number, Identity Card number, email address and nationality (collectively, “Personal Information”).

You may elect to enter information into registration form on behalf of yourself or a third party from whom you have authorization to provide such information. You can request (and in doing so, authorize) QueueMed to provide this information to your chosen Healthcare Provider. You acknowledge and agree that such information will be reviewed and approved by you or someone authorized by you at the time of your appointment to ensure its accuracy. You also acknowledge that QueueMed may use the data or information you provided in accordance with our Privacy Policy.

This Return and Refund policy shall only be applicable for payment made during online booking only.

QueueMed shall use its best efforts to ensure that all bookings are correctly scheduled. Should there be any discrepancy of Booking Details and the Customer wishes for return and refund, please contact customer support via support@queuemed.com within seven (7) days upon booking made. QueueMed may request for photographic proof and/or additional information to properly investigate the issue with your booking and to perform a refund. Customer shall receive their refund within 7 working days upon request of refund is successfully approved. In the event the Customer does not receive any reply from us after the aforesaid period, please contact us at +6019-623 6034for enquiries.

In no event shall QueueMed or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on QueueMed's web site, even if QueueMed or an QueueMed authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
